Welcome to Columbia Structure. These Terms of Service explain how our website, estimates, design tools, pole barn kits, planning support, and construction services may be used. By using our website, requesting an estimate, using our 3D building designer, signing an agreement, making a payment, or ordering products or services from us, you agree to these Terms.
These Terms are intended to work together with any estimate, proposal, invoice, Pre Construction Services Agreement, kit order, construction contract, change order, or other written agreement between you and Columbia Structure. If a signed project agreement conflicts with these Terms, the signed project agreement will control for that specific project.
1. About Columbia Structure
Columbia Structure provides pole barn and post frame building services, including pre engineered pole barn kits, custom pole barn kits, material sourcing, building design support, permitting support when available, and full build construction services in approved service areas.
Some projects may also involve related services through Columbia Groundwork Inc., including site evaluation, excavation and grading, building pad preparation, driveway and access preparation, drainage and stormwater support, utility trenching, water line coordination, sewer or septic connection support, skirting installation, final grading, and site cleanup. These services are only included when they are specifically listed in a written estimate, agreement, or scope of work.
2. Website Use
Our website, online forms, images, posts, advertisements, examples, pricing information, and 3D building designer are provided for general information, customer convenience, design discussion, and estimate preparation.
You agree not to misuse the website, interfere with its operation, submit false information, attempt unauthorized access, copy our content for competing business use, or use our website in a way that violates applicable law.
You must be at least 18 years old to request quotes, submit project information, approve estimates, or enter into any agreement with us.
3. Estimates and Pricing
Estimates are based on the information available at the time they are prepared. Pricing may depend on building size, roof pitch, eave height, snow load, wind exposure, engineering requirements, site location, delivery distance, access conditions, selected materials, doors, windows, concrete, excavation, permitting needs, labor availability, and other project details.
An estimate is not a final contract unless it is accepted and incorporated into a written agreement. We reserve the right to correct clerical errors, material errors, pricing errors, quantity errors, design errors, or omissions before an order is finalized.
Unless stated otherwise in writing, estimates may change due to material price changes, freight changes, engineering changes, code requirements, site conditions, customer requested changes, permitting requirements, or changes required by the local authority having jurisdiction.
4. Pre Engineered Kits and Custom Kits
Pre engineered kits are based on available building designs, engineering assumptions, and standard options. When a pre engineered kit includes stamped plans, that will be stated in the estimate or agreement.
Custom kits are not the same as pre engineered kits. Unless specifically stated otherwise, engineering for a custom kit is not included in the initial estimate. For custom kits, engineering will be priced and paid separately after the budget is approved and the building design has been developed far enough to submit for engineering.
Customer requested changes after design approval may require revised drawings, updated engineering, additional materials, additional labor, additional cost, and added time.
5. 3D Building Designer
Our 3D building designer is a helpful planning and visualization tool. It is not a final engineering document, construction plan, permit drawing, or guaranteed price.
The 3D model may not show every detail needed for construction, including structural connections, grade changes, drainage, utilities, bracing, anchors, fasteners, trim details, snow load, wind exposure, setbacks, easements, or local code requirements.
Final scope, price, materials, engineering, and construction details must be confirmed in writing.
6. Planning, Clearance, and Permitting
When planning and clearance services are included, we may assist with site review, measuring building areas, preparing application information, coordinating required documents, and submitting materials to the local planning or building department.
Columbia Structure and Columbia Groundwork cannot guarantee approval from any city, county, state agency, homeowners association, utility provider, engineer, building official, planning department, fire marshal, health department, or other authority.
The local authority having jurisdiction makes the final decision on permits, setbacks, zoning, land use, drainage, stormwater, environmental requirements, inspections, and final approval.
Unless stated otherwise in writing, the property owner remains responsible for confirming property lines, easements, deed restrictions, access rights, utility locations, zoning limits, homeowners association rules, financing requirements, and whether the proposed building is allowed on the property.
We currently offer planning and clearance support only for projects we are performing as full build projects, unless we agree otherwise in writing.
7. Engineering and Code Compliance
Building code requirements vary by location. Snow load, wind exposure, seismic requirements, frost depth, soil conditions, use of the building, occupancy classification, fire separation, setbacks, and local amendments may affect the final design.
Engineering is only included when specifically stated in writing. Any engineering included in a project is limited to the scope listed in the estimate or agreement.
Engineering does not include items outside the stated scope, such as unrelated site retaining walls, septic systems, utilities, driveways, stormwater systems, existing structures, undocumented soil problems, or owner supplied work, unless those items are clearly included in writing.
8. Orders, Deposits, and Payment
Orders may require deposits, progress payments, final payments, or full payment before materials are ordered, delivered, released, or construction begins. Payment terms will be listed in the estimate, invoice, or written agreement.
Late payments may delay ordering, delivery, engineering, permitting, scheduling, construction, or project completion. We may pause work or withhold delivery until required payments are made.
The customer is responsible for any taxes, permit fees, plan review fees, inspection fees, utility fees, engineering revision fees, financing fees, or other fees not specifically included in writing.
9. Cancellations and Changes
Project cancellations, kit cancellations, and design cancellations may result in charges for work already performed, materials already ordered, engineering already started, administrative time, permit work, restocking costs, freight charges, supplier fees, and other costs incurred before cancellation.
Change requests must be reviewed and approved in writing. Verbal conversations, text messages, or informal comments do not change the scope unless they are confirmed in a written change order or updated agreement.
Changes may affect pricing, schedule, engineering, permits, materials, delivery, and construction sequencing.
10. Kit Delivery and Customer Inspection
For kit deliveries, the customer is responsible for providing safe and reasonable access for delivery vehicles, unloading areas, staging areas, and material storage unless otherwise agreed in writing.
The customer should inspect materials promptly after delivery. Any visible shortage, damage, wrong item, or concern should be reported as soon as possible, preferably within two business days of delivery.
Once materials are delivered, the customer is responsible for protecting them from theft, damage, weather exposure, misuse, site traffic, animals, standing water, and improper storage unless we have agreed in writing to provide storage or protection.
11. Returns and Refunds for Kits
Returns are only accepted for eligible new and unused materials, and only when approved by us in writing.
Unless a different return policy is stated in writing, eligible kit return requests must be made within two days of receiving the product. Approved returns may receive a return label from us. Refunds for approved returns will be processed within five days after the returned materials are received and inspected.
Custom ordered materials, engineered packages, special order items, cut materials, installed materials, damaged materials, opened items, weather damaged materials, altered materials, and materials not in resaleable condition may not be eligible for return.
Shipping, freight, handling, engineering, design time, permit work, administrative work, and completed services may not be refundable unless required by law or agreed in writing.
12. Full Build Construction Services
When full build construction is included, our work is limited to the scope listed in the signed agreement. Any work not listed is excluded unless added by written change order.
The customer must provide safe site access, clear work areas, reasonable staging space, accurate project information, and timely decisions. Delays caused by weather, site access, permits, inspections, utilities, material availability, owner changes, hidden conditions, other contractors, or events outside our control may affect the schedule.
Unforeseen site conditions may require additional work and cost. Examples include poor soils, buried debris, rock, groundwater, undocumented utilities, drainage issues, slope issues, inaccurate grade information, restricted access, or site conditions that differ from the information provided before estimating.
13. Owner Supplied Work and Other Contractors
If the customer or another contractor performs any part of the project, that work must be completed in a way that does not interfere with our work, schedule, materials, access, engineering, inspections, or code compliance.
We are not responsible for delays, defects, rework, inspection failures, damage, or added costs caused by owner supplied work, other contractors, inaccurate information, or work performed outside our scope.
14. Doors, Windows, Concrete, Utilities, and Site Work
Doors, windows, garage doors, man doors, concrete, excavation, grading, utilities, septic work, drainage, and access work are only included when they are specifically listed in the estimate or agreement.
Utility locations must be marked before excavation. The customer is responsible for disclosing known private utilities, irrigation lines, drainage lines, septic components, wells, underground tanks, abandoned utilities, and other hidden site conditions.
We are not responsible for unmarked, unknown, private, abandoned, or incorrectly marked underground items unless required by law or agreed in writing.
15. Product Images, Colors, and Materials
Photos, renderings, samples, and online images are for general reference. Actual colors, textures, trim, finishes, lumber, steel, doors, windows, and other materials may vary due to lighting, screen settings, supplier availability, manufacturing tolerances, and normal material variation.
Material substitutions may be made when needed due to supplier changes, code requirements, availability, or equivalent performance, provided the substituted materials are reasonably comparable for the intended use.
16. Intellectual Property
Our website content, designs, drawings, graphics, images, layouts, written materials, posts, videos, calculators, 3D designer content, estimates, and other materials are owned by Columbia Structure or used with permission.
You may use our materials only for reviewing, planning, purchasing, or discussing your own project with us. You may not copy, sell, publish, reproduce, modify, distribute, or use our materials to compete with us or to have another company replicate our design without written permission.
17. No Guarantee of Project Outcome
We work to provide accurate estimates, quality materials, practical planning, and reliable construction services. However, we do not guarantee that every proposed project will be approved, permitted, financed, built, inspected, or completed exactly as first discussed.
Project outcomes may be affected by local code, engineering, permitting, weather, property conditions, customer decisions, material availability, supplier changes, agency review, inspection results, financing, or other factors outside our control.
18. Warranties
Manufacturer warranties may apply to certain materials, products, doors, windows, steel panels, fasteners, or components. Those warranties are controlled by the manufacturer.
Any workmanship warranty must be stated in the signed project agreement. We do not provide warranties beyond what is stated in writing or required by law.
Normal wear, owner misuse, lack of maintenance, improper drainage, settling, unauthorized modifications, damage by others, storm damage, wind events, snow overload, flooding, fire, pests, and acts of nature are not covered unless required by law or specifically stated in writing.
19. Limitation of Liability
To the fullest extent allowed by law, Columbia Structure is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost use, business interruption, financing losses, delay damages, or damage caused by circumstances outside our control.
Our total liability for any claim related to a product, service, website use, estimate, or project will not exceed the amount paid to us for the specific product or service that caused the claim, unless a greater amount is required by law.
Nothing in these Terms limits any rights that cannot legally be limited.
20. Customer Communications
By submitting a form, requesting an estimate, creating a design, calling, texting, emailing, or communicating with us, you authorize us to contact you about your project, estimate, design, order, service, scheduling, payment, and related business matters.
You are responsible for providing accurate contact information and checking your email, phone, text messages, client portal, and other communication channels for updates.
21. Privacy
We may collect information you provide through our website, forms, design tools, email, phone calls, texts, customer portal, or project documents. This may include your name, contact information, project address, building details, site information, and related project needs.
We use this information to respond to inquiries, prepare estimates, design projects, process orders, coordinate services, communicate with you, improve our services, and perform agreed work.
We do not sell customer project information. We may share project information with engineers, suppliers, subcontractors, delivery providers, permitting agencies, software providers, payment processors, or other parties when reasonably necessary to provide services, complete a project, comply with law, or protect our business.
22. Third Party Services
Our website or services may involve third party tools, payment processors, design software, suppliers, freight companies, engineers, subcontractors, financing providers, permit portals, or outside websites.
We are not responsible for third party websites, software, delays, errors, pricing, policies, availability, or decisions.
23. Disputes
If a concern comes up, you agree to contact us first and give us a reasonable opportunity to review and respond. Many issues can be resolved by reviewing the written scope, estimate, contract, change orders, photos, delivery records, and project communications.
Any dispute will be handled according to the signed agreement for the project. If there is no signed agreement that controls the dispute, the laws of the state where the project is located will generally apply, unless another law is required.
Nothing in these Terms waives any lien rights, bond rights, payment rights, consumer rights, warranty rights, or legal rights that cannot be waived under applicable law.
24. Updates to These Terms
We may update these Terms from time to time. The updated version will be posted on our website with a new updated date. Continued use of our website or services after updates are posted means you accept the updated Terms.
